Learn About the California Fair Labor Standards Act
The California Fair Labor Standards Act provides employees with certain wage and overtime benefits. Every employer that does business in the state of California must adhere to the California Fair Labor Standards Act.
California Fair Labor Standards Act Overview
The California Fair Labor Standards Act requires employers to pay 1.5 times the normal rate of pay when an employee works over 40 hours in one work week. Under the California Fair Labor Standards Act, certain employees are exempt from overtime rules such as those on salary. However, there is a 2 prong test that evaluates each circumstance to see if an employee is exempt or non-exempt from the California Fair Labor Standards Act.
Unlike the federal version of the law, the California Fair Labor Standards Act provides employees with a minimum wage rate of $8 per hour. When compared to the federal minimum requirement of $7.25, California provides a better rate.
The California Fair Labor Standards Act does not provide overtime pay for weekends or holidays. However, it does provide for overtime pay for working over 8 hours in one day. For work hours accumulating over 12 hours in one day, an employee is entitled to double the normal rate of pay.
The California Fair Labor Standards Act also mandates that an employer must pay its employees at least twice per month. The Act also states that employees are entitled to at least a 30 minute meal break after five hours of work, unless the total work period for the day is not over 6 hours. Under the California Fair Labor Standards Act, an employee is also entitled to a paid rest period of 10 minutes after 4 hours of work, with certain limitations.
