Documents needed for labor Commission
Hi-I was working for an employer and deferred all of my salary until Jan 2011 (worked there for 7 months). They never put the agreement in writing. After several conversations during which the employer tried to modify the conditions of employment, I indicated that I wanted the agreement in writing. They then terminated me on the basis that they stated they no longer had the money to pay me. They then refused to pay my back wages (they offered to pay me $1000 per month for the rest of my life!) in a realistic mannger.
I have filed with the Labor Commission and want to know what I need to do to prepare for the hearing. I have a lot of documents that demonstrate how much work I did at the company, as well as a letter from their attorney entitled "Termination of Employment", and several MOUs about my employment that they refused to sign [not because they were not correct or failed to capture the agreement, just because they didn't want to put anything in writing].
Their attorney recently spoke with me on the telephone asking me to send me all of my documentation so that "he could review it and come to a fair conclusion". I told him that his source needed to be his clients - I would provide him nothing.
I think that these people are trying to take advantage of me. I have been extremely generous with them over the past few months but I am not a patsy.
The outstanding amount is about $87,500.
